Terms of Service

1. Nature of Services

GETUSDONE ("the Platform") is a decentralized user interface that simplifies the process of interacting with the Solana blockchain. We provide tools to help users compose transactions for sending digital assets as gifts.

2. No Affiliation with Token Issuers

The Platform allows users to transfer various tokens, including but not limited to USD1 (World Liberty Financial).

3. Limitation of Liability

To the maximum extent permitted by applicable law, GETUSDONE and its developers shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, resulting from:

• User Error: Sending funds to the wrong address, losing private keys, or typographical errors in recipient details.
• Blockchain Failures: Network congestion, high gas fees, failed transactions, or protocol-level exploits on the Solana network.
• Third-Party Services: Failures, bugs, or downtime associated with your wallet provider (e.g., Phantom, Solflare) or RPC nodes.
• Regulatory Actions: Any government inquiry, investigation, or action that affects the availability of the Platform.

4. User Responsibilities

By using the Platform, you represent and warrant that:

• You are of legal age and capacity to agree to these Terms.
• You are not located in, or a resident of, any jurisdiction where the use of this Platform is prohibited by law.
• You will verify all transaction details (Recipient Address, Amount, Token Type) independently before signing any transaction.
• You acknowledge that blockchain transactions are irreversible.

5. No Financial Advice

The content, charts, market data, and tools provided on this Platform are for informational and operational purposes only. Nothing herein constitutes financial, investment, legal, or tax advice. You should conduct your own due diligence and consult with a qualified professional before making any financial decisions regarding digital assets.

6. Beta Availability

The Platform is currently in a "Beta" phase. We do not guarantee that the Platform will be error-free, bug-free, or available at all times. We reserve the right to modify, suspend, or discontinue any part of the service at any time without notice.

7. Indemnification

You agree to defend, indemnify, and hold harmless GETUSDONE and its developers from and against any claims, damages, costs, liabilities, and expenses (including, but not limited to, attorney's fees) arising out of or related to your use of the Platform or your violation of these Terms.

8. Tax Obligations

You are solely responsible for determining what, if any, taxes apply to your crypto gifts. This includes:

• Reporting any capital gains triggered by disposing of (gifting) an asset.
• Adhering to Gift Tax limits or reporting requirements in your jurisdiction (e.g., IRS Form 709 in the US).
• Understanding that the recipient may inherit your cost basis in certain jurisdictions.

GETUSDONE does not collect, report, or withhold taxes on your behalf.

9. Card Payments and Stripe

GETUSDONE supports two separate ways to move money, and they work differently. Card payments are processed by Stripe. Crypto transfers happen on-chain and are covered in the sections above.

Card payment processing is provided by Stripe and is subject to the Stripe Connected Account Agreement, which includes the Stripe Services Agreement. By accepting card payments through GETUSDONE you agree to be bound by that agreement, as it may be modified by Stripe from time to time. If you disagree with it, you may not accept card payments through the Platform.

To accept cards you must create a connected Stripe account through the Platform and keep the information on it complete, accurate and current. Each business you add is its own connected account. Stripe, not GETUSDONE, decides whether an account may accept payments or receive payouts, and may restrict or close an account under its own agreement.

Card details are captured and handled entirely by Stripe, whether through a contactless tap on your device or a hosted checkout page. GETUSDONE does not receive, process or store full card numbers. Funds from card sales settle to your connected Stripe account and are paid out to the bank account you connect, on Stripe's payout schedule. GETUSDONE does not hold your funds.

10. Identity Verification

There are two separate verification processes, and passing one does not complete the other.

Businesses accepting card payments. Stripe verifies the identity of the business and its owners before money can move, as it is required to do as a regulated payment processor. This happens during payout setup. Stripe may ask for identification, business details and bank information, and may request more at any time. GETUSDONE cannot override, accelerate or substitute for Stripe's decision.

Individuals sending crypto. Before you can send gifts or transfer tokens, you must complete an identity check performed by our third-party verification provider. We do this because value moves on-chain irreversibly and we are required to know who is sending it. We receive the outcome of that check, the session reference and the time it was decided. We do not receive or retain copies of your identification documents or biometric data.

We may refuse, suspend or reverse access to either capability where verification fails, where information appears inaccurate, or where we are required to do so by law.

11. Fees, Refunds and Chargebacks

GETUSDONE charges a platform fee on each card sale, shown in the app before you charge a customer. Stripe's own processing fees are separate and are set by Stripe. Network fees on crypto transfers are set by the blockchain and are not ours.

You may refund a card sale from the app. Refunding returns our platform fee to you; Stripe's processing fee on the original payment is generally not returned. Crypto transfers are final: once a transaction is confirmed on-chain it cannot be reversed by us, by you, or by anyone else.

If a cardholder disputes a payment, the dispute is decided by the card network and Stripe. You are responsible for disputed amounts and any related fees, and for providing evidence in response. We may offset amounts you owe against funds otherwise payable to you.

12. Compliance & Prohibited Use

You agree not to use the Platform for any illicit activity, including but not limited to money laundering, terrorist financing, or evading sanctions. You confirm that neither you nor the recipient are on any trade or economic sanctions lists, such as the UN Security Council Sanctions list or the OFAC Specially Designated Nationals (SDN) list.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of [Your Jurisdiction, e.g., the State of Wyoming, USA], without regard to its conflict of law provisions.
